These Terms of Service govern your use of Things With Wings (the “platform”). By creating an account or using the platform, you agree to these terms. Please read them carefully.

1. Eligibility

You must be at least 13 years old to use Things With Wings. By registering, you confirm that you meet this requirement. If you are under 18, you should have parental consent.

2. Your Account

You are responsible for maintaining the security of your account credentials. You must not share your account with others or use another person’s account. Notify us immediately at [email protected] if you suspect unauthorised access.

3. User Content

Ownership

You retain full copyright ownership of all photos and content you upload. By uploading, you grant Things With Wings a non-exclusive, royalty-free licence to display, store, and distribute your content on the platform.

Your Responsibilities

You must only upload content that:

• You took yourself or have explicit permission to share
• Does not infringe any third-party copyright or intellectual property rights
• Does not contain adult content, hate speech, harassment, or illegal material
• Is genuinely wildlife photography — not AI-generated or manipulated to misrepresent species

Species Accuracy

Please make a genuine effort to correctly identify species when uploading. The community can suggest corrections via the species suggestion feature.

4. Community Rules

• Treat other members with respect in comments and messages
• Do not post spam, promotional content, or unsolicited messages
• Do not deliberately misidentify species or manipulate votes
• Wildlife welfare comes first — do not share location data for sensitive or protected species that could be disturbed

We reserve the right to remove content or suspend accounts that violate these rules.

5. Paid Memberships

Warden is £5.99 monthly or £49.99 yearly. Guardian is £9.99 monthly or £79.99 yearly. Subscriptions renew automatically unless cancelled before the renewal date. You can manage or cancel your plan through the Stripe billing portal linked from the upgrade page.

Payments are processed by Stripe. Your statutory consumer rights are unaffected. Unless required by law, partially used billing periods are not automatically refunded; contact us if a technical failure prevented use of a paid feature.

6. GPS and Location Data

Photos may contain GPS coordinates extracted from EXIF data. You control whether this is shared publicly via the privacy toggle on each photo. Please be mindful of sharing precise locations of rare, protected, or easily disturbed species.

7. Availability and Changes

We aim to keep Things With Wings available at all times but cannot guarantee uninterrupted service. We reserve the right to modify or discontinue features with reasonable notice. These terms may be updated from time to time — continued use of the platform constitutes acceptance of updated terms.

8. Limitation of Liability

Things With Wings is provided “as is”. We are not liable for any loss of data, revenue, or indirect damages arising from your use of the platform. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
